r\u00e9dig\u00e9.<\/p>\n\n\n\n<p>Parce que le contrat de bail ne sert pas uniquement \u00e0 organiser la location.<\/p>\n\n\n\n<p>Le contrat de bail sert aussi <strong>\u00e0 prot\u00e9ger le bailleur<\/strong>.<\/p>\n\n\n\n<p>Il n\u2019emp\u00eachera pas les impay\u00e9s.<\/p>\n\n\n\n<p>Mais il pourra vous aider \u00e0 r\u00e9gler la situation bien plus facilement, avec la loi de votre c\u00f4t\u00e9.<\/p>\n\n\n\n<p>Ce petit miracle, <strong>c\u2019est la clause r\u00e9solutoire<\/strong>.<\/p>\n\n\n\n<p>Et je vais vous expliquer comment vous en servir !&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les points \u00e0 retenir&nbsp;<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u200b\ud83d\udd14 La clause r\u00e9solutoire permet la r\u00e9siliation de plein droit du contrat de bail<\/li>\n\n\n\n<li>\ud83d\udd14\u200b Les motifs de r\u00e9siliation du bail sont encadr\u00e9s par la loi<\/li>\n\n\n\n<li>\u200b\ud83d\udd14\u200b La clause r\u00e9solutoire doit absolument \u00eatre \u00e9crite dans le contrat de bail pour \u00eatre appliqu\u00e9e<\/li>\n\n\n\n<li>\u200b\ud83d\udd14\u200b L\u2019application d\u2019une clause r\u00e9solutoire est toujours pr\u00e9c\u00e9d\u00e9e d\u2019une mise en demeure et d\u2019un commandement de commissaire de justice (sauf pour les troubles de voisinage)<\/li>\n\n\n\n<li>\u200b\ud83d\udd14\u200b Le juge intervient en dernier recours pour constater la validit\u00e9 de la clause r\u00e9solutoire<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Qu\u2019est-ce qu\u2019une clause r\u00e9solutoire ?<\/strong><\/h2>\n\n\n\n<p><strong>Petite mais costaud !<\/strong><\/p>\n\n\n\n<p>C\u2019est comme \u00e7a que je r\u00e9sumerais la clause r\u00e9solutoire !<\/p>\n\n\n\n<p>Elle se cache dans le contrat de bail.<\/p>\n\n\n\n<p>Elle ne fait jamais plus de quelques lignes.<\/p>\n\n\n\n<p>Pourtant, <strong>elle est tr\u00e8s puissante<\/strong>.&nbsp;<\/p>\n\n\n\n<p>La clause r\u00e9solutoire permet, tout simplement, de r\u00e9silier automatiquement le bail lorsqu\u2019une obligation n\u2019est pas remplie par l\u2019une des parties au contrat.&nbsp;<\/p>\n\n\n\n<p><strong><em>Exemple<\/em><\/strong> : <em>Une clause r\u00e9solutoire peut pr\u00e9voir que si le locataire ne paye pas son loyer, le bail sera r\u00e9sili\u00e9 de plein droit.<\/em><\/p>\n\n\n\n\n \t\t         \t\t<a class=\"lm_img_container\" href=\"\">\n\t \t\t<img decoding=\"async\" src=\"\" class=\"lm_sidebar_main_lead_magnet\">\n class=\"wp-block-heading\"><strong>Les diff\u00e9rents motifs de la clause r\u00e9solutoire<\/strong><\/h2>\n\n\n\n<p>Bien entendu, la clause r\u00e9solutoire <strong>ne peut pas exister pour n\u2019importe quel motif.&nbsp;<\/strong><\/p>\n\n\n\n<p>Comme d\u2019habitude, <strong>la loi encadre strictement <\/strong>les motifs de fin de bail.<\/p>\n\n\n\n<p>Par exemple, une clause r\u00e9solutoire qui indiquerait que le bail sera r\u00e9sili\u00e9 de plein droit si le locataire adopte un poisson rouge, sera r\u00e9put\u00e9e non \u00e9crite.<\/p>\n\n\n\n<p>En bref, vous ne pourrez pas l\u2019utiliser pour mettre votre locataire dehors.<\/p>\n\n\n\n<p>Voici les motifs qui permettent \u00e0 votre clause r\u00e9solutoire d\u2019\u00eatre (vraiment) valide.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Clause r\u00e9solutoire : non-paiement du loyer et\/ou des charges<\/strong><\/h3>\n\n\n\n<p>C\u2019est le motif n\u00b01 qui inqui\u00e8te tout bailleur averti !<\/p>\n\n\n\n<p>Parce que sans paiement du loyer, <strong>le mod\u00e8le de l\u2019investissement locatif s\u2019effondre.<\/strong><\/p>\n\n\n\n<p>Il est donc<strong> <\/strong><strong>extr\u00eamement judicieux<\/strong> de pr\u00e9voir dans votre contrat de bail une clause r\u00e9solutoire pour d\u00e9faut de paiement du loyer (et des charges locatives).&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Clause r\u00e9solutoire : troubles anormaux de voisinage<\/strong><\/h3>\n\n\n\n<p>Souvent sous-estim\u00e9s, les troubles anormaux de voisinage peuvent faire de gros d\u00e9g\u00e2ts.<\/p>\n\n\n\n<p>Si votre locataire ne respecte pas son obligation d\u2019user paisiblement du bien lou\u00e9, il s\u2019expose certes \u00e0 des sanctions juridiques (libre au syndic et aux voisins de porter plainte), <strong>mais il s\u2019expose aussi au courroux de la clause r\u00e9solutoire !<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Clause r\u00e9solutoire : absence de souscription \u00e0 une assurance habitation<\/strong><\/h3>\n\n\n\n<p>Discr\u00e8te, l\u2019assurance habitation ne fait que rarement parler d\u2019elle pendant la dur\u00e9e du bail.<\/p>\n\n\n\n<p>G\u00e9n\u00e9ralement, le bailleur v\u00e9rifie au d\u00e9but, et puis voil\u00e0.<\/p>\n\n\n\n<p>Sauf que techniquement, vous avez le droit (et je vous le conseille fortement) de demander <strong>chaque ann\u00e9e<\/strong> \u00e0 votre locataire <strong>une preuve qu\u2019il a bien souscrit une assurance habitation.<\/strong><\/p>\n\n\n\n<p>Si ce n\u2019est pas le cas\u2026 clause r\u00e9solutoire !<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Clause r\u00e9solutoire : absence de versement du d\u00e9p\u00f4t de garantie<\/strong><\/h3>\n\n\n\n<p>La signature du bail est presque toujours assortie d\u2019un d\u00e9p\u00f4t de garantie.<\/p>\n\n\n\n<p>Je pense que vous avez compris le principe. Clause r\u00e9solutoire.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/www.monsieurhugo.com\/blog\/wp-content\/uploads\/2026\/04\/image-3.png\" alt=\"motifs-clause-resolutoire-bail\" class=\"wp-image-360744\" srcset=\"https:\/\/www.monsieurhugo.com\/blog\/wp-content\/uploads\/2026\/04\/image-3.png 1024w, https:\/\/www.monsieurhugo.com\/blog\/wp-content\/uploads\/2026\/04\/image-3-980x735.png 980w, https:\/\/www.monsieurhugo.com\/blog\/wp-content\/uploads\/2026\/04\/image-3-480x360.png 480w\" sizes=\"(min-width: 0px) and (max-width: 480px) 480px, (min-width: 481px) and (max-width: 980px) 980px, (min-width: 981px) 1024px, 100vw\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Comment faire appliquer une clause r\u00e9solutoire ?<\/strong><\/h2>\n\n\n\n<p>La th\u00e9orie, c\u2019est bien, la pratique, c\u2019est mieux !<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>La clause r\u00e9solutoire doit exister<\/strong><\/h3>\n\n\n\n<p>Vous allez me trouver un peu sanguin, mais c\u2019est tellement important qu\u2019il faudrait l\u2019\u00e9crire en police 150, gras soulign\u00e9, au milieu de l\u2019article (ne me tentez pas).<\/p>\n\n\n\n<p>Pour appliquer la clause r\u00e9solutoire, il faut\u2026 qu\u2019elle existe.<\/p>\n\n\n\n<p>\u00c7a para\u00eet \u00e9vident, mais pourtant de nombreux bailleurs oublient de l\u2019\u00e9crire dans le contrat de bail.<\/p>\n\n\n\n<p>Ou ne sont pas assez explicites dans sa formulation.&nbsp;<\/p>\n\n\n\n<p><strong>R\u00e9sultat : au moment de l\u2019appliquer, ils sont bloqu\u00e9s<\/strong><strong>.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>La mise en demeure<\/strong><\/h3>\n\n\n\n<p>La clause r\u00e9solutoire, c\u2019est la r\u00e9siliation de plein droit du contrat.<\/p>\n\n\n\n<p>Mais ce n\u2019est pas totalement automatique pour autant.&nbsp;<\/p>\n\n\n\n<p>Si vous constatez un manquement de votre locataire \u00e0 ses obligations, vous devez avant tout <strong>lui envoyer une mise en demeure.<\/strong><\/p>\n\n\n\n<p>Vous lui rappelez ses obligations.<\/p>\n\n\n\n<p>Vous lui signifiez le d\u00e9lai dont il dispose pour r\u00e9gulariser sa situation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Le commandement d\u00e9livr\u00e9 par commissaire de justice<\/strong><\/h3>\n\n\n\n<p>Bon, la mise en demeure n\u2019a rien donn\u00e9.<\/p>\n\n\n\n<p>Il est temps de faire appel \u00e0 un commissaire de justice (anciennement huissier de justice).<\/p>\n\n\n\n<p>Si la clause r\u00e9solutoire concerne le versement du loyer, un <strong>commandement de payer<\/strong> est d\u00e9livr\u00e9 au locataire par le commissaire de justice.<\/p>\n\n\n\n<p>La loi pr\u00e9voit express\u00e9ment <strong>le contenu du commandement de payer<\/strong> :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La mention que le locataire dispose d&rsquo;un d\u00e9lai de six semaines pour payer sa dette<\/li>\n\n\n\n<li>Le montant mensuel du loyer et des charges<\/li>\n\n\n\n<li>Le d\u00e9compte de la dette<\/li>\n\n\n\n<li>L&rsquo;avertissement qu&rsquo;\u00e0 d\u00e9faut de paiement ou d&rsquo;avoir sollicit\u00e9 des d\u00e9lais de paiement, le locataire s&rsquo;expose \u00e0 une proc\u00e9dure judiciaire de r\u00e9siliation de son bail et d&rsquo;expulsion<\/li>\n\n\n\n<li>La mention de la possibilit\u00e9 pour le locataire de saisir le fonds de solidarit\u00e9 pour le logement de son d\u00e9partement, dont l&rsquo;adresse est pr\u00e9cis\u00e9e, aux fins de solliciter une aide financi\u00e8re<\/li>\n\n\n\n<li>La mention de la possibilit\u00e9 pour le locataire de saisir, \u00e0 tout moment, la juridiction comp\u00e9tente aux fins de demander un d\u00e9lai de gr\u00e2ce<\/li>\n<\/ul>\n\n\n\n<p>Concernant le paiement du d\u00e9p\u00f4t de garantie et le d\u00e9faut d\u2019assurance habitation, <strong>un commandement de commissaire de justice est \u00e9galement d\u00e9livr\u00e9 au locataire.<\/strong><\/p>\n\n\n\n<p>Le seul cas sp\u00e9cifique concerne <strong>les troubles anormaux de voisinage<\/strong>. Dans cette situation, pas de commandement de commissaire de justice. On passe directement \u00e0 l\u2019\u00e9tape d\u2019apr\u00e8s : <strong>le juge<\/strong>.<\/p>\n\n\n\n\n \t\t         \t\t<a class=\"lm_img_container\" href=\"\">\n\t \t\t<img decoding=\"async\" src=\"\" class=\"lm_sidebar_main_lead_magnet\">\n \t\t<\/a>\n \t\t \t\t\n \t\t\n \t\t \n<!-- Pour faire appara\u00eetre, mettre \u00e7a dans le IF : if ($args[\"shortcode_location\"] === \"lm-list\" )-->\n\t\n\n\n\n\n\n<h2 class=\"wp-block-heading\"><strong>L\u2019application de la clause r\u00e9solutoire par le juge<\/strong><\/h2>\n\n\n\n<p>La mise en demeure n\u2019a rien donn\u00e9, le commandement de payer non plus.<\/p>\n\n\n\n<p><strong>Il nous reste donc le passage devant le juge.<\/strong><\/p>\n\n\n\n<p>En principe, rien de bien compliqu\u00e9.&nbsp;<\/p>\n\n\n\n<p>Le juge se contente d\u2019appliquer la clause r\u00e9solutoire.&nbsp;<\/p>\n\n\n\n<p>Il v\u00e9rifie que la clause est bien r\u00e9dig\u00e9e et valable.<\/p>\n\n\n\n<p>Il v\u00e9rifie que les conditions d\u2019application de la clause sont bien r\u00e9unies.<\/p>\n\n\n\n<p>Et enfin, la clause r\u00e9solutoire peut \u00eatre mise en \u0153uvre !<\/p>\n\n\n\n<p><strong>Cas particulier des troubles anormaux de voisinage : <\/strong>le juge va v\u00e9rifier que les troubles sont bien caract\u00e9ris\u00e9s. Il ne se contente donc pas de v\u00e9rifier que la clause r\u00e9solutoire est valide.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Petite\u2026 mais bien utile !<\/strong><\/h2>\n\n\n\n<p>L\u2019int\u00e9r\u00eat principal de la clause r\u00e9solutoire r\u00e9side surtout dans l\u2019\u00e9tape finale : <strong>le juge se contente de l\u2019appliquer si tous les \u00e9l\u00e9ments sont r\u00e9unis.&nbsp;<\/strong><\/p>\n\n\n\n<p>Le juge n\u2019a pas \u00e0 se demander si oui ou non il faut r\u00e9silier.<\/p>\n\n\n\n<p>Il va v\u00e9rifier que la clause r\u00e9solutoire s\u2019applique.<\/p>\n\n\n\n<p>L\u2019al\u00e9a pour le bailleur est donc plus faible qu\u2019en passant par une proc\u00e9dure classique.<\/p>\n\n\n\n<p>Mon seul conseil : r\u00e9digez correctement votre clause r\u00e9solutoire pour \u00e9viter les mauvaises surprises !<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La hantise de tout bailleur, c\u2019est clairement les impay\u00e9s (avec les squatteurs peut \u00eatre, mais \u00e7a c\u2019est une autre paire de manches).
