Si vous \u00eates d\u2019accord, vous pouvez r\u00e9diger un avenant au contrat de bail afin de modifier la date d\u2019exigibilit\u00e9 du loyer.<\/em><\/p>\n\n\n\n\n \t\t         \t\t<a class=\"lm_img_container\" href=\"\">\n\t \t\t<img decoding=\"async\" src=\"\" class=\"lm_sidebar_main_lead_magnet\">\n \t\t<\/a>\n \t\t \t\t\n \t\t\n \t\t \n<!-- Pour faire appara\u00eetre, mettre \u00e7a dans le IF : if ($args[\"shortcode_location\"] === \"lm-list\" )-->\n\t\n\n\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le locataire est-il oblig\u00e9 d\u2019accepter l\u2019avenant au contrat de location ?<\/strong><\/h2>\n\n\n\n<p>La dictature immobili\u00e8re est en marche !<\/p>\n\n\n\n<p>Ou pas.<\/p>\n\n\n\n<p>\u00c9videmment, <strong>l\u2019accord du locataire est n\u00e9cessaire<\/strong> pour \u00e9tablir un avenant au contrat de bail.<\/p>\n\n\n\n<p>Vous ne pouvez pas modifier unilat\u00e9ralement le bail.&nbsp;<\/p>\n\n\n\n<p>\u00c0 l\u2019origine, le contrat de bail na\u00eet de la volont\u00e9 du bailleur ET du locataire.&nbsp;<\/p>\n\n\n\n<p>Il est donc logique que le bailleur ne puisse pas modifier le bail comme il le souhaite, sans recueillir l\u2019accord de son locataire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Qui doit signer l\u2019avenant au contrat de location ?<\/strong><\/h2>\n\n\n\n<p>L\u2019avenant au contrat de bail doit \u00eatre sign\u00e9 <strong>par deux personnes<\/strong> :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Signature du bailleur<\/li>\n\n\n\n<li>Signature du locataire<\/li>\n<\/ul>\n\n\n\n<p>S\u2019il s\u2019agit d\u2019une colocation et que l\u2019avenant concerne un <strong>bail commun, <\/strong>tous les colocataires doivent signer l\u2019avenant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les cas les plus fr\u00e9quents d\u2019avenant au contrat de bail<\/strong><\/h2>\n\n\n\n<p>Je ne dirais pas qu\u2019il est monnaie courante de faire un avenant au contrat de location.<\/p>\n\n\n\n<p>Mais il existe des situations qui favorisent la r\u00e9daction d\u2019un avenant par le propri\u00e9taire.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Changement de colocataire<\/strong><\/h3>\n\n\n\n<p>La colocation, surtout \u00e9tudiante, est tr\u00e8s fr\u00e9quente.<\/p>\n\n\n\n<p>Il y a un peu <strong>deux \u00e9coles<\/strong> :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le bailleur qui choisit de faire un bail unique pour tous les colocataires, aussi appel\u00e9 bail commun<\/li>\n\n\n\n<li>Le bailleur qui choisit de faire un bail par colocataire<\/li>\n<\/ul>\n\n\n\n<p>Un bail par colocataire ne pose pas de question en cas de d\u00e9part.<\/p>\n\n\n\n<p>Le bail cesse.<\/p>\n\n\n\n<p>Un nouveau bail est r\u00e9dig\u00e9 pour le colocataire suivant.<\/p>\n\n\n\n<p>Les autres colocataires n\u2019ont rien \u00e0 faire, puisqu\u2019ils suivent leur propre bail.<\/p>\n\n\n\n<p>Par contre, dans le cas d\u2019un bail commun, le d\u00e9part d\u2019un colocataire n\u00e9cessite un avenant :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pour signifier qu\u2019il n\u2019est plus colocataire\u00a0<\/li>\n\n\n\n<li>Pour \u00e9ventuellement ajouter un nouveau colocataire qui le remplace<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Modification du montant du loyer<\/strong><\/h3>\n\n\n\n<p>En principe, l\u2019augmentation annuelle du loyer <strong>se fait simplement <\/strong>:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le propri\u00e9taire signifie au locataire l\u2019augmentation en fonction de l\u2019indice applicable<\/li>\n\n\n\n<li>Le locataire paye d\u00e9sormais le nouveau loyer<\/li>\n<\/ul>\n\n\n\n<p><strong>Pas besoin de faire un avenant au contrat de bail.<\/strong><\/p>\n\n\n\n<p>Mais certaines modifications du loyer sortent du cadre de la r\u00e9vision annuelle :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Travaux d\u2019am\u00e9lioration du logement entra\u00eenant une hausse du loyer<\/li>\n\n\n\n<li>Loyer modifi\u00e9 d\u2019un commun accord en dehors de la r\u00e9vision annuelle<\/li>\n<\/ul>\n\n\n\n<p>Ainsi, en cas de travaux d\u2019am\u00e9lioration du logement en cours de bail, faisant augmenter sa valeur, le propri\u00e9taire peut solliciter une augmentation du loyer <strong>via un avenant au contrat de location.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Changement d\u2019usage du logement<\/strong><\/h3>\n\n\n\n<p>Le contrat de bail pr\u00e9voit g\u00e9n\u00e9ralement <strong>une clause qui emp\u00eache le locataire d\u2019exercer une activit\u00e9 professionnelle dans le logement.<\/strong><\/p>\n\n\n\n<p>Cette clause est souvent mise par d\u00e9faut &#8211;
