Appr\u00e9ci\u00e9es par les propri\u00e9taires, les GLI r\u00e9pondent aux nombreuses <strong>d\u00e9faillances des locataires<\/strong> et offrent la garantie d&rsquo;une prise en charge des frais d&rsquo;expulsion.&nbsp;<\/p>\n\n\n\n<p>Seulement <strong>3% des propri\u00e9taires<\/strong> bailleurs ont souscrit \u00e0 une <strong>GLI<\/strong>.<\/p>\n\n\n\n<p>Que valent-elles r\u00e9ellement ?&nbsp;<\/p>\n\n\n\n<p><strong>Ce que dit la loi ?<\/strong><\/p>\n\n\n\n<p>L&rsquo;article 7 de la Loi du 06 juillet 1989 oblige le locataire \u00e0 payer son loyer \u00e0 la date convenue dans le contrat de bail. En cas de <strong>loyer impay\u00e9<\/strong>, le <strong>propri\u00e9taire<\/strong> dispose de <strong>recours<\/strong> pour <strong>recouvrer<\/strong> les sommes.&nbsp;<\/p>\n\n\n\n<p>La Garantie Loyers Impay\u00e9s (GLI) offre la garantie pour l&rsquo;assur\u00e9 propri\u00e9taire de se voir rembourser les loyers non vers\u00e9s par le locataire, en cas de d\u00e9faillance de ce dernier, d\u00e8s le 1er loyer non vers\u00e9. Le propri\u00e9taire se verra ainsi reverser par son assurance le loyer, les charges et les taxes.&nbsp;<\/p>\n\n\n\n<p>Certains contrats GLI couvrent \u00e9galement d&rsquo;autres frais, \u00e0 savoir les honoraires d&rsquo;avocats, d&rsquo;huissiers de justice, les frais de proc\u00e9dure d&rsquo;expulsion&#8230;<\/p>\n\n\n\n<p><strong>Les avantages de la GLI&nbsp;:<\/strong><\/p>\n\n\n\n<p>La GLI offre ainsi plusieurs avantages :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le propri\u00e9taire est <strong>couvert en cas de loyers<\/strong> et de charges impay\u00e9s, <strong>peu importe le motif du locataire<\/strong>,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La garantie GLI couvre les <strong>frais de proc\u00e9dures<\/strong> de recouvrement et parfois <strong>d&rsquo;expulsion<\/strong>,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Offre une protection contre les <strong>d\u00e9t\u00e9riorations<\/strong> ou d\u00e9gradations dans le bien,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La GLI est <strong>d\u00e9ductible fiscalement<\/strong>,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&rsquo;assureur est tenu de rembourser le propri\u00e9taire d\u00e8s le 1er mois de loyer impay\u00e9.<\/li>\n<\/ul>\n\n\n\n<p><strong>N\u00e9anmoins, la GLI pr\u00e9sente \u00e9galement certains inconv\u00e9nients :&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La <strong>proc\u00e9dure<\/strong> peut s&rsquo;av\u00e9rer <strong>compliqu\u00e9e<\/strong> et <strong>longue<\/strong> : le propri\u00e9taire doit remplir un dossier sinistre aupr\u00e8s de son assureur et joindre les documents n\u00e9cessaires pour prouver la d\u00e9faillance du locataire,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La garantie a un <strong>co\u00fbt<\/strong> financier correspondant \u00e0 un pourcentage des loyers mensuels per\u00e7us (de 1 \u00e0 5% en g\u00e9n\u00e9ral),<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Il n&rsquo;est <strong>pas possible<\/strong> de faire appel \u00e0 un <strong>garant<\/strong> et de souscrire par la m\u00eame occasion une Garantie Loyers Impay\u00e9s,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le <strong>locataire<\/strong> doit r\u00e9pondre \u00e0 des <strong>crit\u00e8res d&rsquo;\u00e9ligibilit\u00e9<\/strong> (exclusion de certains locataires) : un revenu fixe, un ratio loyer\/salaire net maximum (en moyenne 2,5 fois le loyer charges comprises)&#8230;<\/li>\n<\/ul>\n\n\n\n<p><strong>Concr\u00e8tement en cas d\u2019impay\u00e9, que devez-vous faire&nbsp;?&nbsp;<\/strong><\/p>\n\n\n\n<p>La <strong>r\u00e9solution du bail<\/strong> ne pourra \u00eatre envisag\u00e9e qu&rsquo;en la pr\u00e9sence d&rsquo;une <strong>clause r\u00e9solutoire en cas de non-paiement des loyers <\/strong>(bien v\u00e9rifier donc la pr\u00e9sence de cette clause dans votre bail&nbsp;!)<strong>.<\/strong><\/p>\n\n\n\n<p>Le bailleur devra adresser par voie <strong>d&rsquo;huissier<\/strong> un <strong>commandement de payer<\/strong> pr\u00e9cisant les sommes r\u00e9clam\u00e9es. Le locataire aura alors <strong>2 mois<\/strong> pour payer les sommes dues au bailleur.<\/p>\n\n\n\n<p>Sans r\u00e9action de la part du locataire, le bailleur pourra saisir le <strong>juge civil<\/strong> devant le <strong>Tribunal d&rsquo;instance<\/strong> pour faire constater le non-paiement des loyers. Le <strong>juge<\/strong> pourra prononcer la <strong>r\u00e9siliation du bail<\/strong> et ordonner <strong>l&rsquo;expulsion<\/strong> du locataire. \u00c0 l&rsquo;issue, le propri\u00e9taire pourra saisir un Huissier de justice qui proc\u00e9dera \u00e0 l&rsquo;expulsion (hors p\u00e9riode de tr\u00e8ve hivernale).&nbsp;<\/p>\n\n\n\n<p>Les frais en lien avec la proc\u00e9dure d&rsquo;expulsion peuvent, selon certains contrats, \u00eatre pris en charge par la GLI. Cependant, l&rsquo;assureur limite sa garantie \u00e0 hauteur d&rsquo;un montant maximum pour chaque situation.<\/p>\n\n\n\n<p><strong>Faites attention aux clauses d&rsquo;exclusion de la Garantie Loyers Impay\u00e9s&nbsp;!<\/strong><\/p>\n\n\n\n<p><strong>Avant d&rsquo;engager la Garantie Loyers Impay\u00e9s<\/strong>, le bailleur reste tenu d&rsquo;adresser au locataire une <strong>lettre de relance<\/strong>, puis une <strong>lettre de mise en demeure<\/strong>. C&rsquo;est uniquement en cas d&rsquo;absence de r\u00e9action du locataire fautif suite \u00e0 ces d\u00e9marches que le bailleur pourra actionner la GLI.<\/p>\n\n\n\n<p>En outre, certains contrats de <strong>GLI<\/strong> <strong>obligent le bailleur<\/strong> \u00e0 avoir d\u00e9livr\u00e9 un <strong>commandement de payer<\/strong> demeur\u00e9 infructueux avant de d\u00e9clarer le sinistre et d&rsquo;indemniser le bailleur.&nbsp;<br>Enfin <strong>l&rsquo;assureur<\/strong> peut limiter sa responsabilit\u00e9 \u00e0 un certain seuil. Ainsi, il couvrira jusqu&rsquo;\u00e0 une <strong>dur\u00e9e maximale<\/strong> le <strong>remboursement des loyers impay\u00e9s<\/strong>.
