Ce choix a des cons\u00e9quences sur la proc\u00e9dure et le <strong>maintien des aides en cas de loyers impay\u00e9s<\/strong>.<\/p>\n\n\n\n<p><strong>Cas 1<\/strong>&nbsp;: le <strong>propri\u00e9taire<\/strong> bailleur <strong>re\u00e7oit directement les aides de la CAF<\/strong> : le locataire a l&rsquo;obligation de payer son loyer et ses charges, moins le tiers payant.<\/p>\n\n\n\n<p>A d\u00e9faut de r\u00e8glement pendant 2 mois, l&rsquo;<strong>impay\u00e9<\/strong> est constitu\u00e9 : le <strong>propri\u00e9taire<\/strong> bailleur a alors <strong>2 mois pour le d\u00e9clarer \u00e0 la CAF<\/strong>. <strong>A d\u00e9faut<\/strong> de d\u00e9claration dans le d\u00e9lai, la <strong>CAF<\/strong> peut demander au propri\u00e9taire bailleur le <strong>remboursement des allocations<\/strong> logement qu&rsquo;il a per\u00e7ues depuis la constitution de l&rsquo;impay\u00e9, et le paiement d&rsquo;une amende.<\/p>\n\n\n\n<p>S&rsquo;il <strong>respecte le d\u00e9lai<\/strong>, le <strong>bailleur<\/strong> peut continuer \u00e0 <strong>b\u00e9n\u00e9ficier du tiers payant pendant 6 mois<\/strong>, le temps de mettre en place un plan d&rsquo;apurement ou de permettre au locataire de r\u00e9gler ses dettes. A d\u00e9faut de plan ou de r\u00e8glement des impay\u00e9s, la CAF cesse de payer.<\/p>\n\n\n\n\n \t\t         \t\t<a class=\"lm_img_container\" href=\"\">\n\t \t\t<img decoding=\"async\" src=\"\" class=\"lm_sidebar_main_lead_magnet\">\n \t\t<\/a>\n \t\t \t\t\n \t\t\n \t\t \n<!-- Pour faire appara\u00eetre, mettre \u00e7a dans le IF : if ($args[\"shortcode_location\"] === \"lm-list\" )-->\n\t\n\n\n\n\n\n<p><strong>Cas 2<\/strong>&nbsp;: Les <strong>allocations<\/strong> logement sont <strong>vers\u00e9es<\/strong> au <strong>locataire<\/strong>.<\/p>\n\n\n\n<p>En cas de proc\u00e9dure d&rsquo;impay\u00e9, la CAF propose au bailleur de lui verser directement l&rsquo;aide au logement. Le propri\u00e9taire re\u00e7oit les allocations pendant 6 mois, au terme desquels la CAF cesse de payer \u00e0 d\u00e9faut de plan d&rsquo;apurement ou de r\u00e8glement des impay\u00e9s.<\/p>\n\n\n\n<p>Quand la CAF cesse de payer une partie des loyers du locataire d\u00e9faillant, les loyers impay\u00e9s co\u00fbtent cher au bailleur. Pour y pallier, il peut envisager plusieurs solutions :<\/p>\n\n\n\n<p>1\u00b0 Faire jouer son assurance loyers impay\u00e9s ou actionner la caution. Cette mesure peut \u00eatre prise d\u00e8s le 1er impay\u00e9, et pendant toute la proc\u00e9dure d&rsquo;impay\u00e9 mise en \u0153uvre par la CAF.<\/p>\n\n\n\n<p>2\u00b0 Engager une proc\u00e9dure judiciaire pour recouvrer les loyers impay\u00e9s : le propri\u00e9taire peut demander \u00e0 faire proc\u00e9der \u00e0 des saisies par huissier. A d\u00e9faut de paiement malgr\u00e9 un commandement de payer, le bailleur peut demander la r\u00e9solution du contrat de bail et l&rsquo;expulsion du locataire d\u00e9faillant. Cette mesure est envisageable en l&rsquo;absence de plan d&rsquo;apurement ou lorsque le locataire ne respecte pas ses engagements \u00e0 ce titre, provoquant la suspension des aides au logement de la CAF.<\/p>\n\n\n\n<p><strong>Ce que dit la loi ?<\/strong><\/p>\n\n\n\n<p>L&rsquo;article R*351-30 du Code de la construction et de l&rsquo;habitation impose au <strong>bailleur<\/strong> de <strong>d\u00e9clarer une situation d&rsquo;impay\u00e9 \u00e0 la CAF<\/strong> lorsque le locataire b\u00e9n\u00e9ficie d&rsquo;aides au logement. La CAF met alors en place une proc\u00e9dure d&rsquo;apurement. A d\u00e9faut de respect de la proc\u00e9dure, la CAF cesse de payer les allocations.<\/p>\n\n\n\n<p>L&rsquo;article 7 de la loi du 06 juillet 1989 impose au locataire de payer son loyer et ses charges \u00e0 la date convenue. Le d\u00e9faut de paiement autorise le bailleur \u00e0 invoquer la clause r\u00e9solutoire du contrat de bail, le cas \u00e9ch\u00e9ant, et \u00e0 demander l&rsquo;expulsion du locataire d\u00e9faillant.&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n\n \t\t         \t\t<a class=\"lm_img_container\" href=\"\">\n\t \t\t<img decoding=\"async\" src=\"\" class=\"lm_sidebar_main_lead_magnet\">\n \t\t<\/a>\n \t\t \t\t\n \t\t\n \t\t \n<!-- Pour faire appara\u00eetre, mettre \u00e7a dans le IF : if ($args[\"shortcode_location\"] === \"lm-list\" )-->\n\t\n\n\n\n\n\n<p><strong>En cas d\u2019impay\u00e9, la proc\u00e9dure est sp\u00e9cifique&nbsp;<\/strong><\/p>\n\n\n\n<p>La <strong>loi<\/strong> impose au bailleur une <strong>proc\u00e9dure sp\u00e9cifique<\/strong> lorsque la <strong>CAF paye une partie du loyer<\/strong>. Le bailleur doit en effet pr\u00e9venir la CAF, qui tente de mettre en place une proc\u00e9dure de nature \u00e0 \u00e9viter l&rsquo;expulsion du locataire. Ce n&rsquo;est qu&rsquo;\u00e0 <strong>d\u00e9faut de respect du plan d&rsquo;apurement que la CAF cesse de payer les allocations<\/strong> : \ud83e\udc6a le propri\u00e9taire peut alors engager une <strong>proc\u00e9dure d&rsquo;expulsion<\/strong>.<\/p>\n\n\n\n<p><em>A noter<\/em> : pendant toute la proc\u00e9dure d&rsquo;impay\u00e9 mise en oeuvre par la CAF, le propri\u00e9taire peut se tourner vers sa garantie loyers impay\u00e9s ou la caution du locataire pour obtenir le paiement des loyers.<\/p>\n\n\n\n<p>Voici les 2 \u00e9tapes \u00e0 suivre&nbsp;:<\/p>\n\n\n\n<p><strong>1\u00e8re \u00e9tape : mettre en place un plan d&rsquo;apurement<\/strong>.<\/p>\n\n\n\n<p>Une fois les impay\u00e9s d\u00e9clar\u00e9s, la CAF accompagne le propri\u00e9taire bailleur dans la mise en \u0153uvre d&rsquo;un plan d&rsquo;apurement. Le bailleur et le locataire doivent consentir aux modalit\u00e9s du plan.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le plan est respect\u00e9 : la CAF continue de verser une partie du loyer, et le propri\u00e9taire r\u00e9cup\u00e8re progressivement ses cr\u00e9ances de loyer.<\/li>\n\n\n\n<li>Les parties ne se mettent pas d&rsquo;accord ou ne respectent pas les modalit\u00e9s du plan : la CAF cesse de verser les allocations logement au propri\u00e9taire.
