Il pr\u00e9voit&nbsp;:<\/p>\n\n\n\n<p>\u00ab&nbsp;<strong>Est r\u00e9put\u00e9e non \u00e9crite<\/strong> toute clause&nbsp;:<\/p>\n\n\n\n<p>[\u2026]<\/p>\n\n\n\n<p>Qui interdit au locataire d\u2019h\u00e9berger des personnes ne vivant pas habituellement avec celui-ci.&nbsp;\u00bb<\/p>\n\n\n\n<p><strong>Donc le locataire peut h\u00e9berger qui il veut, proche ou pas, \u00e0 condition d\u2019occuper en m\u00eame temps le logement&nbsp;: vous ne pourrez pas lui interdire de le faire.<\/strong><\/p>\n\n\n\n<p>La jurisprudence reconna\u00eet m\u00eame au locataire la facult\u00e9 d\u2019h\u00e9berger chez lui des membres de sa famille, tout en continuant d\u2019occuper le logement (Civ. 3\u00e8me, 14 d\u00e9c. 1994, N\u00b092-15.129 Bull. Civ. III n\u00b0210 et CA Paris, 27 f\u00e9vrier 1987, RG n\u00b0 S6\/I5832).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>CAS n\u00b02&nbsp;: le locataire pr\u00eate votre logement&nbsp;<\/strong><\/h2>\n\n\n\n<p>Ce qui est interdit, et qui pr\u00eate souvent \u00e0 confusion, c\u2019est le pr\u00eat du logement en l\u2019absence du locataire.<\/p>\n\n\n\n<p>Ex&nbsp;: Votre locataire part en vacances pendant 3 semaines et pr\u00eate son logement \u00e0 des amis.<\/p>\n\n\n\n<p>Le pr\u00eat du logement en l\u2019absence de locataire doit n\u00e9anmoins \u00eatre interdit via une clause explicite dans le bail.<\/p>\n\n\n\n<p>Avez-vous mis en place cette clause dans votre bail&nbsp;?<\/p>\n\n\n\n<p>V\u00e9rifiez ce point important en prenant le temps de relire votre bail.&nbsp;<\/p>\n\n\n\n<p><strong>Ainsi, si vous n\u2019avez pas ins\u00e9r\u00e9 une clause interdisant \u00e0 votre locataire de pr\u00eater votre logement en son absence, vous ne pourrez pas vous y opposer.<\/strong><\/p>\n\n\n\n<p>Contrairement \u00e0 la sous-location qui est-elle interdite implicitement sans besoin d\u2019\u00e9crire une clause.<\/p>\n\n\n\n\n \t\t         \t\t<a class=\"lm_img_container\" href=\"\">\n\t \t\t<img decoding=\"async\" src=\"\" class=\"lm_sidebar_main_lead_magnet\">\n \t\t<\/a>\n \t\t \t\t\n \t\t\n \t\t \n<!-- Pour faire appara\u00eetre, mettre \u00e7a dans le IF : if ($args[\"shortcode_location\"] === \"lm-list\" )-->\n\t\n\n\n\n\n\n<h2 class=\"wp-block-heading\"><strong>CAS n\u00b03&nbsp;: le locataire sous-loue votre logement<\/strong><\/h2>\n\n\n\n<p>L\u2019h\u00e9bergement est \u00e0 diff\u00e9rencier de la sous-location qui consiste pour un locataire \u00e0 mettre \u00e0 disposition d\u2019un tiers son logement en contrepartie d\u2019un loyer. En d\u2019autres termes la sous-location est un contrat de location verbal ou \u00e9crit conclu entre un locataire et une autre personne, le sous-locataire.<\/p>\n\n\n\n<p><strong>Si votre locataire sous-loue le logement sans votre autorisation, vous \u00eates en droit de r\u00e9silier son bail.<\/strong><\/p>\n\n\n\n<p>L\u2019h\u00e9bergement familial ne constitue pas une sous location prohib\u00e9e (Civ. 3\u00e8me, 14 d\u00e9c. 1994, N\u00b092-15.129 Bull. Civ.
