Elle permet de d\u00e9terminer la surface totale disponible \u00e0 l\u2019habitation effective d\u2019un logement et \u00e0 ce titre, elle est obligatoirement mentionn\u00e9e dans le bail de location et l\u2019acte de vente. C\u2019est elle qui est prise en compte dans le calcul de la taxe fonci\u00e8re et de la taxe d\u2019habitation.\u00a0<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">La superficie privative (loi Carrez) ne se calcule qu\u2019en copropri\u00e9t\u00e9. Elle se rapproche de la d\u00e9finition de la surface habitable puisqu\u2019il s\u2019agit de la superficie des planchers des locaux clos et couverts apr\u00e8s d\u00e9duction des surfaces occup\u00e9es par les murs, cloisons, marches et cages d&rsquo;escalier, gaines, embrasures de portes et de fen\u00eatres.\u00a0<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">Il n&rsquo;est l\u00e0 aussi pas tenu compte des planchers des parties des locaux d&rsquo;une hauteur inf\u00e9rieure \u00e0 1,80 m\u00e8tre.\u00a0<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">Mais la diff\u00e9rence technique vient du fait qu\u2019on tient compte dans le calcul des combles non am\u00e9nag\u00e9s, sous-sols et autres d\u00e9pendances.\u00a0<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">La surface loi Carrez doit obligatoirement figurer dans les actes de vente d\u00e8s lors qu\u2019elle concerne une surface sup\u00e9rieure \u00e0 8 m2.
