En nu ou en meubl\u00e9.<\/span><\/p>\n<p><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">Il existe toutefois une exception : si vous avez sign\u00e9 avec votre locataire un bail pour un appartement <strong>meubl\u00e9 avant le 27 mars 2014<\/strong>, et si le bail ne <\/span><\/span><\/span><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\"><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">comporte pas de <strong>clause<br \/>interdisant la sous-location ou la conditionnant<\/strong>,<\/span><\/span><\/span><\/span> votre locataire pourra alors sous-louer l&rsquo;appartement sans votre autorisation.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: large;\">Dans tous les autres cas, pas d&rsquo;accord du propri\u00e9taire bailleur = pas de sous location.<\/span><span style=\"font-size: large;\">\u00a0<\/span><\/p>\n<p><span style=\"font-size: large;\">Mais voil\u00e0, votre locataire est pass\u00e9 outre votre accord, quels sont alors vos recours ?<\/span><\/p>\n<p><span style=\"font-size: large;\">Si vous faite la preuve que votre locataire a sous lou\u00e9 le logement sans votre accord, vous pourrez demander au tribunal :<\/span><\/p>\n<p><span style=\"font-size: large;\">\u2212 la <strong>restitution des loyers<\/strong> per\u00e7u ill\u00e9galement,<\/span><\/p>\n<p><span style=\"font-size: large;\">\u2212 l\u2019<strong>expulsion<\/strong> du sous-locataire,<\/span><\/p>\n<p><span style=\"font-size: large;\">\u2212 des <strong>dommages et int\u00e9r\u00eats<\/strong>,<\/span><\/p>\n<p><span style=\"font-size: large;\">\u2212 la <strong>r\u00e9siliation du bail<\/strong>.<\/span><\/p>\n<p><span style=\"font-size: large;\">Votre locataire ne se verra pas forcement appliquer toutes ces peines. Ce sera au juge d\u2019appr\u00e9cier la gravit\u00e9 des faits avant de statuer. Mais les d\u00e9cisions r\u00e9centes laissent pr\u00e9sager une plus grande s\u00e9v\u00e9rit\u00e9 des magistrats en mati\u00e8re de sous-location ill\u00e9gale. <\/span><\/p>\n<p><span style=\"font-size: large;\">A titre d&rsquo;exemple, le <a href=\"http:\/\/www.leparisien.fr\/economie\/une-locataire-qui-sous-louait-son-appartement-a-paris-sur-airbnb-severement-condamnee-27-10-2018-7929411.php\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: blue;\"><u>24 octobre 2018<\/u><\/span><\/a>, une locataire parisienne a \u00e9t\u00e9 condamn\u00e9e \u00e0 payer 46 000 euros \u00e0 son propri\u00e9taire pour avoir sous-lou\u00e9 entre 2001 et 2018 son appartement sur une plateforme de location sans l&rsquo;accord de son propri\u00e9taire.
