Cela signifie que l\u2019immeuble est destin\u00e9 en son entier \u00e0 de l\u2019habitation. Cela signifie en principe que les activit\u00e9s lib\u00e9rales et d\u2019habitation y sont autoris\u00e9es, ou encore \u00e0 usage mixte, permettant l\u2019activit\u00e9 commerciale sous r\u00e9serve de respecter l\u2019affectation des lots.<\/span><\/li>\n<\/ul>\n<p>Mais sur ce dernier point, la Cour de cassation a r\u00e9cemment chang\u00e9 de ton : le 8 mars 2018 (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000036718345&amp;fastReqId=906120276&amp;fastPos=1\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: blue;\"><u>arr\u00eat n\u00b014-15.864<\/u><\/span><\/a>), elle admet que les <strong>locations de meubl\u00e9s touristiques ne correspondent pas \u00e0 la destination d\u2019un immeuble \u00e0 usage mixte professionnel-habitation<\/strong>.<br \/> Les juges ont retenu que contrairement \u00e0 une profession lib\u00e9rale o\u00f9 les allers et venues des patients\/clients n\u2019ont lieu qu\u2019en journ\u00e9e et font courir un moindre risque de nuisances, que les meubl\u00e9s touristiques quant \u00e0 eux louent g\u00e9n\u00e9ralement un appartement pour quelques jours de vacances, seront davantage enclins \u00e0 <strong>n\u00e9gliger la r\u00e9glementation de l\u2019immeuble et la tranquillit\u00e9 de ses habitants permanents<\/strong>.<\/p>\n<p>Mais m\u00eame si le r\u00e8glement n\u2019interdit pas express\u00e9ment cette activit\u00e9, le propri\u00e9taire qui exerce l\u2019activit\u00e9 de location meubl\u00e9e de courte dur\u00e9e est tenu de respecter la tranquillit\u00e9 de l\u2019immeuble et les droits des autres copropri\u00e9taires, faute de risquer de se voir assigner pour <strong>trouble anormal de voisinage.<\/strong><\/p>\n<p>Il est aussi \u00e0 noter que le r\u00e8glement \u00e9tant la loi des parties, les copropri\u00e9taires peuvent tenter de <strong>modifier le r\u00e8glement de copropri\u00e9t\u00e9<\/strong> en interdisant ou autorisant la location saisonni\u00e8re lors d\u2019une assembl\u00e9e g\u00e9n\u00e9rale.
