Vous pourrez donc augmenter vos loyers d&rsquo;1,53%.<\/p>\n<p>Mais qu&rsquo;est ce que l&rsquo;IRL et comment s&rsquo;en servir ?<\/p>\n<p>Voici les explications en 6 points.<\/p>\n<h3>1. L\u2019IRL sert de base<\/h3>\n<p>L&rsquo;indice de r\u00e9f\u00e9rence des loyers (IRL) sert de base pour r\u00e9viser les loyers des logements vides ou meubl\u00e9s. L\u2019INSEE publie chaque trimestre un indice IRL. Il est calcul\u00e9 \u00e0 partir de la moyenne, sur les 12 derniers mois, de l&rsquo;\u00e9volution des prix \u00e0 la consommation (hors tabac et hors loyers).<\/p>\n<p>L\u2019IRL fixe les plafonds des augmentations annuelles des loyers que peuvent exiger les propri\u00e9taires. Autrement dit : l\u2019augmentation du loyer annuelle ne peut pas d\u00e9passer la variation de l\u2019IRL sur 1 an.<\/p>\n<h3>2. L&rsquo;IRL permet de proc\u00e9der \u00e0 la r\u00e9vision du loyer<\/h3>\n<p>Pour r\u00e9viser un loyer selon l&rsquo;IRL, votre bail doit <strong>IMPERATIVEMENT<\/strong> contenir une clause d&rsquo;indexation.<\/p>\n<p>La r\u00e9vision du loyer, se fait une fois par an, \u00e0 la date convenue dans le contrat de location. Il peut s\u2019agir de la date anniversaire du contrat, ou une autre date convenue dans le bail (exemple le 1er janvier de chaque ann\u00e9e).<\/p>\n<p>La premi\u00e8re indexation se fait un an apr\u00e8s l\u2019arriv\u00e9e du locataire dans le logement sur la base de la derni\u00e8re valeur de l\u2019IRL publi\u00e9.<\/p>\n<h3>3. Il y a 4 IRL par an. Mais lequel choisir ?<\/h3>\n<p>Si aucune date n\u2019est indiqu\u00e9e dans le bail (date convenue entre votre locataire et vous, ou, date anniversaire du contrat), c\u2019est par d\u00e9faut, la date du dernier IRL publi\u00e9 par l&rsquo;INSEE \u00e0 la date de la signature du bail qui sera prise en compte.<\/p>\n<p>L\u2019INSEE publie 4 IRL par an. Pour chaque trimestre, elle calcule l\u2019\u00e9volution des prix et publie l\u2019IRL correspondant une dizaine de jours apr\u00e8s la fin du trimestre :<\/p>\n<ul>\n<li>1er trimestre N publication de l\u2019IRL entre le 11 et le 15 avril N,<\/li>\n<li>2\u00e8me trimestre N publication entre le 11 et le 15 juillet N,<\/li>\n<li>3\u00e8me trimestre N publication entre le 11 et le 15 octobre N,<\/li>\n<li>4\u00e8me trimestre N publication entre le 11 et le 15 janvier N+1.<\/li>\n<\/ul>\n<p><strong>Le trimestre \u00e0 retenir pour votre calcul est le dernier publi\u00e9 au jour de la signature du bail.<\/strong><\/p>\n<p>Par exemple :<\/p>\n<p>Pour un bail sign\u00e9 le 8 janvier 2019, le dernier IRL connu et publi\u00e9 par l\u2019INSEE est celui du 3\u00e8me trimestre 2018 (dernier trimestre connu au 8 janvier. Celui du 4\u00e8me trimestre n\u2019est paru que le 15 janvier 2019 soit quelques jours apr\u00e8s la date de signature du bail).<\/p>\n<p>Les derni\u00e8res valeurs de l\u2019IRL publi\u00e9es par l\u2019INSEE sont les suivants :<\/p>\n<table style=\"border-collapse: collapse; J&rsquo;ai mon IRL mais comment calculer la r\u00e9vision de loyer ?<\/h3>\n<p>La r\u00e9vision du loyer n\u2019est pas automatique. Pour calculer l&rsquo;augmentation du montant du loyer, vous avez besoin des 3 \u00e9l\u00e9ments suivants :<\/p>\n<ul>\n<li>le montant du loyer actuel hors charges,<\/li>\n<li>le nouvel IRL du trimestre de r\u00e9f\u00e9rence (pr\u00e9vu dans le bail ou publi\u00e9 par l&rsquo;Insee au moment de la signature du bail),<\/li>\n<li>et l\u2019IRL du m\u00eame trimestre de l&rsquo;ann\u00e9e pr\u00e9c\u00e9dente.<\/li>\n<\/ul>\n<p>La formule de calcul est :<\/p>\n<p>Nouveau loyer = Loyer en cours X nouvel IRL du trimestre de r\u00e9f\u00e9rence du contrat \/ IRL du m\u00eame trimestre de l&rsquo;ann\u00e9e pr\u00e9c\u00e9dente.<\/p>\n<p>Pour calculer l\u2019indexation du loyer, il vous faudra utiliser le nouvel indice publi\u00e9 le m\u00eame trimestre de r\u00e9f\u00e9rence que celui indiqu\u00e9 dans le bail.<\/p>\n<p>Prenons l\u2019exemple d\u2019un bail sign\u00e9 le 20 mai 2018 pour un loyer mensuel de 700 \u20ac hors charges. Vous pourrez r\u00e9\u00e9valuer le loyer le 20 mai 2019.<\/p>\n<ul>\n<li>Le dernier indice publi\u00e9 \u00e0 la date de signature du bail est celui du 1er trimestre 2018, soit 127,22. Le nouvel indice publi\u00e9 \u00e0 la date de r\u00e9\u00e9valuation est celui du 1e trimestre 2019, soit 129,38.<\/li>\n<\/ul>\n<p>Au 20 mai 2019, le montant mensuel du loyer r\u00e9\u00e9valu\u00e9 sera de :<\/p>\n<p>700 \u20ac x 129,38\/ 127,22= 711,88 \u20ac.<\/p>\n<p>Pour vous aider \u00e0 calculer l\u2019augmentation du loyer, l\u2019Etat a mis en place un outil en ligne que vous pouvez utiliser <span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\">:\u00a0<\/span><a href=\"https:\/\/www.anil.org\/outils\/outils-de-calcul\/revision-de-loyer\/\" target=\"_blank\" rel=\"noopener noreferrer\"><u><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">https:\/\/www.anil.org\/outils\/outils-de-calcul\/revision-de-loyer\/<\/span><\/span><\/u><\/a><\/p>\n<h3>5. Comment informer mon locataire de la r\u00e9vision du loyer ?<\/h3>\n<p>Vous devez informer vos locataires du nouveau montant du loyer avec une lettre de notification de r\u00e9vision du loyer.<\/p>\n<p>Cette lettre doit comporter :<\/p>\n<ul>\n<li>l\u2019adresse du logement concern\u00e9,<\/li>\n<li>la date de r\u00e9vision du loyer,<\/li>\n<li>la date \u00e0 laquelle l\u2019augmentation prendra effet,<\/li>\n<li>le nouveau montant du loyer mensuel,<\/li>\n<li>les modalit\u00e9s de calcul du nouveau loyer.<\/li>\n<\/ul>\n<p>Cette lettre de r\u00e9vision de loyer doit \u00eatre envoy\u00e9e \u00e0 votre locataire par courrier recommand\u00e9 avec accus\u00e9 r\u00e9ception.<\/p>\n<h3>6. Puis-je r\u00e9viser le loyer quand je veux ?<\/h3>\n<p>Vous disposez d&rsquo;un d\u00e9lai d&rsquo;1 an, \u00e0 compter de la date pr\u00e9vue dans le bail, pour faire la demande de r\u00e9vision. Celle-ci prendra effet au jour de sa demande ; elle n\u2019est donc pas r\u00e9troactive. Pass\u00e9 le d\u00e9lai d\u2019un an, la r\u00e9vision du loyer pour l\u2019ann\u00e9e \u00e9coul\u00e9e n&rsquo;est plus possible.<\/p>\n<p><strong><span style=\"color: #006fad;\">Conclusion<\/span><\/strong><\/p>\n<p>L&rsquo;augmentation du loyer \u00e0 l&rsquo;aide de l&rsquo;IRL n&rsquo;est pas obligatoire. Certains propri\u00e9taires ne l&rsquo;appliquent pas. Libre \u00e0 chacun de faire comme il le souhaite. L'IRL permet de proc\u00e9der \u00e0 la r\u00e9vision du loyer<\/h3><p>Pour r\u00e9viser un loyer selon l'IRL, votre bail doit <strong>IMPERATIVEMENT<\/strong> contenir une clause d'indexation.<\/p><p>La r\u00e9vision du loyer, se fait une fois par an, \u00e0 la date convenue dans le contrat de location. Il peut s\u2019agir de la date anniversaire du contrat, ou une autre date convenue dans le bail (exemple le 1er janvier de chaque ann\u00e9e).<\/p><p>La premi\u00e8re indexation se fait un an apr\u00e8s l\u2019arriv\u00e9e du locataire dans le logement sur la base de la derni\u00e8re valeur de l\u2019IRL publi\u00e9.<\/p><h3>3. Il y a 4 IRL par an. Mais lequel choisir ?<\/h3><p>Si aucune date n\u2019est indiqu\u00e9e dans le bail (date convenue entre votre locataire et vous, ou, date anniversaire du contrat), c\u2019est par d\u00e9faut, la date du dernier IRL publi\u00e9 par l'INSEE \u00e0 la date de la signature du bail qui sera prise en compte.<\/p><p>L\u2019INSEE publie 4 IRL par an. Pour chaque trimestre, elle calcule l\u2019\u00e9volution des prix et publie l\u2019IRL correspondant une dizaine de jours apr\u00e8s la fin du trimestre :<\/p><ul><li>1er trimestre N publication de l\u2019IRL entre le 11 et le 15 avril N,<\/li><li>2\u00e8me trimestre N publication entre le 11 et le 15 juillet N,<\/li><li>3\u00e8me trimestre N publication entre le 11 et le 15 octobre N,<\/li><li>4\u00e8me trimestre N publication entre le 11 et le 15 janvier N+1.<\/li><\/ul><p><strong>Le trimestre \u00e0 retenir pour votre calcul est le dernier publi\u00e9 au jour de la signature du bail.<\/strong><\/p><p>Par exemple :<\/p><p>Pour un bail sign\u00e9 le 8 janvier 2019, le dernier IRL connu et publi\u00e9 par l\u2019INSEE est celui du 3\u00e8me trimestre 2018 (dernier trimestre connu au 8 janvier. J'ai mon IRL mais comment calculer la r\u00e9vision de loyer ?<\/h3><p>La r\u00e9vision du loyer n\u2019est pas automatique. Pour calculer l'augmentation du montant du loyer, vous avez besoin des 3 \u00e9l\u00e9ments suivants :<\/p><ul><li>le montant du loyer actuel hors charges,<\/li><li>le nouvel IRL du trimestre de r\u00e9f\u00e9rence (pr\u00e9vu dans le bail ou publi\u00e9 par l'Insee au moment de la signature du bail),<\/li><li>et l\u2019IRL du m\u00eame trimestre de l'ann\u00e9e pr\u00e9c\u00e9dente.<\/li><\/ul><p>La formule de calcul est :<\/p><p>Nouveau loyer = Loyer en cours X nouvel IRL du trimestre de r\u00e9f\u00e9rence du contrat \/ IRL du m\u00eame trimestre de l'ann\u00e9e pr\u00e9c\u00e9dente.<\/p><p>Pour calculer l\u2019indexation du loyer, il vous faudra utiliser le nouvel indice publi\u00e9 le m\u00eame trimestre de r\u00e9f\u00e9rence que celui indiqu\u00e9 dans le bail.<\/p><p>Prenons l\u2019exemple d\u2019un bail sign\u00e9 le 20 mai 2018 pour un loyer mensuel de 700 \u20ac hors charges. Vous pourrez r\u00e9\u00e9valuer le loyer le 20 mai 2019.<\/p><ul><li>Le dernier indice publi\u00e9 \u00e0 la date de signature du bail est celui du 1er trimestre 2018, soit 127,22. Le nouvel indice publi\u00e9 \u00e0 la date de r\u00e9\u00e9valuation est celui du 1e trimestre 2019, soit 129,38.<\/li><\/ul><p>Au 20 mai 2019, le montant mensuel du loyer r\u00e9\u00e9valu\u00e9 sera de :<\/p><p>700 \u20ac x 129,38\/ 127,22= 711,88 \u20ac.<\/p><p>Pour vous aider \u00e0 calculer l\u2019augmentation du loyer, l\u2019Etat a mis en place un outil en ligne que vous pouvez utiliser <span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\">:\u00a0<\/span><a href=\"https:\/\/www.anil.org\/outils\/outils-de-calcul\/revision-de-loyer\/\" target=\"_blank\" rel=\"noopener noreferrer\"><u><span style=\"font-family: 'arial' , 'helvetica' , sans-serif;\"><span style=\"font-size: large;\">https:\/\/www.anil.org\/outils\/outils-de-calcul\/revision-de-loyer\/<\/span><\/span><\/u><\/a><\/p><h3>5. Comment informer mon locataire de la r\u00e9vision du loyer ?<\/h3><p>Vous devez informer vos locataires du nouveau montant du loyer avec une lettre de notification de r\u00e9vision du loyer.<\/p><p>Cette lettre doit comporter :<\/p><ul><li>l\u2019adresse du logement concern\u00e9,<\/li><li>la date de r\u00e9vision du loyer,<\/li><li>la date \u00e0 laquelle l\u2019augmentation prendra effet,<\/li><li>le nouveau montant du loyer mensuel,<\/li><li>les modalit\u00e9s de calcul du nouveau loyer.<\/li><\/ul><p>Cette lettre de r\u00e9vision de loyer doit \u00eatre envoy\u00e9e \u00e0 votre locataire par courrier recommand\u00e9 avec accus\u00e9 r\u00e9ception.<\/p><h3>6. Puis-je r\u00e9viser le loyer quand je veux ?<\/h3><p>Vous disposez d'un d\u00e9lai d'1 an, \u00e0 compter de la date pr\u00e9vue dans le bail, pour faire la demande de r\u00e9vision. Celle-ci prendra effet au jour de sa demande ; elle n\u2019est donc pas r\u00e9troactive. Pass\u00e9 le d\u00e9lai d\u2019un an, la r\u00e9vision du loyer pour l\u2019ann\u00e9e \u00e9coul\u00e9e n'est plus possible.<\/p><p><strong><span style=\"color: #006fad;\">Conclusion<\/span><\/strong><\/p><p>L'augmentation du loyer \u00e0 l'aide de l'IRL n'est pas obligatoire. Certains propri\u00e9taires ne l'appliquent pas. Libre \u00e0 chacun de faire comme il le souhaite.
