Elles ont toutefois l\u2019obligation d\u2019accepter la nouvelle assurance sous 2 conditions :<\/span><\/p>\n<ul>\n<li><span style=\"font-size: large;\">le respect de la part de l&#8217;emprunteur d\u2019un pr\u00e9avis de 2 mois,<\/span><\/li>\n<li><span style=\"font-size: large;\">le nouveau contrat doit offrir un niveau de garanties identique \u00e0 l\u2019ancien. <\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: large;\">La loi stipule en effet explicitement que \u00ab le pr\u00eateur ne peut pas refuser en garantie un autre contrat d&rsquo;assurance d\u00e8s lors que ce contrat pr\u00e9sente <strong>un niveau de garantie \u00e9quivalent<\/strong> \u00bb. Chaque banque d\u00e9termine un certain nombre de crit\u00e8res : <strong>11 sur une liste de 18<\/strong> crit\u00e8res objectifs fix\u00e9s par d\u00e9cret (<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006069565&amp;idArticle=LEGIARTI000030516400&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: blue;\"><u>article R312-0-1 du code de la consommation<\/u><\/span><\/a>) d\u00e9finissant les <strong>garanties minimales exig\u00e9es<\/strong>. Ces crit\u00e8res sont <strong>obligatoirement communiqu\u00e9s<\/strong> par la banque dans la fiche personnalis\u00e9e remise lors de la n\u00e9gociation du pr\u00eat. Il faudra que la nouvelle assurance pr\u00e9sente les m\u00eames crit\u00e8res. <\/span><\/p>\n<p><span style=\"font-size: large;\"> L&#8217;emprunteur doit alors envoyer sa demande de substitution par <strong>lettre recommand\u00e9e<\/strong> avec avis de r\u00e9ception \u00e0 sa banque. La banque a l&rsquo;obligation de traiter la demande dans les <strong>10 jours<\/strong> suivant la r\u00e9ception du courrier pour <strong>accepter ou refuser par une d\u00e9cision motiv\u00e9e<\/strong>.<\/span><span style=\"font-size: large;\"><br \/> <\/span><br \/> <span style=\"font-size: large;\"> Mais jusqu&rsquo;ici les banques entretenaient le flou quant \u00e0 la <strong>date anniversaire<\/strong>. La loi ne pr\u00e9cisant en effet aucune date de r\u00e9f\u00e9rence, le choix de celle-ci \u00e9tait laiss\u00e9 \u00e0 l\u2019<strong>appr\u00e9ciation des banques<\/strong>.<\/span><\/p>\n<p><span style=\"font-size: large;\"> Certaines utilisent la date de signature de l\u2019offre de pr\u00eat, d\u2019autres la date d\u2019\u00e9dition de l\u2019offre de pr\u00eat immobilier, d&rsquo;autres encore la date d\u2019effet du contrat d\u2019assurance, qui correspond \u00e0 la date de pr\u00e9l\u00e8vement de la premi\u00e8re \u00e9ch\u00e9ance d\u2019assurance, ou encore la date de signature de la demande d\u2019adh\u00e9sion au contrat d\u2019assurance. <\/span><\/p>\n<p><span style=\"font-size: large;\"> Pourquoi ?
